Terms and Conditions for Lopeman Photography

Effective: October 4, 2022 – Present

This agreement governs all photography and videography services provided by Lopeman Photography(“Photographer,” “we,” “us”) to the Client (“you,” “your”). By booking services, the Client agrees to the following Terms and Conditions:

1. Consent for Photography & Model Release

By participating in any session or event, Client grants Lopeman Photography permission to photograph/film them and all individuals included in the session.

Client grants a perpetual, worldwide, royalty-free license for use of images/videos in marketing, website, portfolio, print, advertising, and social media.

Client waives any right to approve images or claim compensation.

If the Client does NOT want images used for promotional purposes, they must state this in writing prior to the session.

2. Copyright & Usage Rights

All images and videos are protected by U.S. Copyright Law (Title 17).
Lopeman Photography retains full copyright ownership.

Client receives a non-exclusive, non-transferable, personal-use license.

Images may not be:

  • sold

  • edited in a misleading manner

  • submitted to contests

  • used commercially

  • altered through AI

  • passed off as the Client’s photographic work

Commercial use requires a paid licensing agreement.

3. Payment Terms

Non-Wedding Sessions: 50% non-refundable booking fee.
Weddings: 25–50% non-refundable booking fee.

Final payments:

  • Sessions: due 2 weeks before the scheduled date.

  • Weddings: due 1 month before the event.

Late Payment Fee: $50 per week.
Returned Payments: Client pays all fees associated with returned or disputed charges.

All payments are non-refundable.

4. Rescheduling & Cancellations

Clients may reschedule once with 1-week notice at no charge.
Additional reschedules or reschedules with less than 1 week notice = $75 fee.

Cancellations at any time result in loss of booking fee.

If Photographer must cancel due to emergency or illness, a full refund will be issued and reasonable efforts will be made to find an approved replacement.

Weather reschedules are at Photographer’s discretion.

5. Delivery of Images & Editing Policy

Standard turnaround: 1–3 weeks
Rush turnaround (4 days): $100

RAW/Unedited files will never be released under any circumstances.

Editing includes:

  • color correction

  • exposure adjustments

  • cropping

  • basic retouching

Advanced editing (face swaps, body adjustments, object removal) may incur additional fees.

6. Travel & Overtime Fees

Travel within 30 miles of Waterloo, NE is included.
Beyond 30 miles: $0.75 per mile round trip.

Travel exceeding 1 hour 30 minutes may require hotel accommodations paid by Client.

Overtime: $150 per hour, rounded to nearest half hour.

7. Client Conduct, Cooperation & Responsibilities

To ensure quality results, the Client agrees to:

  • follow posing instructions

  • direct minors or pets as needed

  • arrive on time

  • ensure all participants behave safely and respectfully

Lopeman Photography is not responsible for poor results caused by:

  • Subjects not following directions

  • Subjects not smiling

  • Subjects refusing to look at the camera

  • Shy or uncooperative behavior

  • Blinking, fidgeting, or lack of expression

  • Wardrobe malfunctions

  • Messy hair or makeup

  • Glasses glare or hats shading the face

  • Unsuitable weather

  • Environmental limitations

Photographer will always make reasonable efforts, but uncooperative subjects or lack of participation are entirely the Client’s responsibility.
No refunds or partial refunds will be issued for these situations.

Additionally, Photographer is not responsible for:

  • Missed shots due to late arrivals

  • Venue restrictions

  • Guest interference

  • Family members wandering off or refusing to participate

  • Children not sitting still, smiling, or cooperating

By booking, the Client acknowledges that final images are influenced by the Client’s willingness and ability to participate.

8. Liability & Injury

Client assumes all responsibility for personal safety at sessions.

Photographer is not liable for:

  • injuries

  • accidents

  • property damage

  • allergic reactions

  • environmental hazards

Client is responsible for repairing or replacing any equipment damaged by Client or guests.

9. Limitation of Liability

Photographer is not liable for:

  • equipment failure

  • memory card corruption

  • transportation delays

  • illness

  • acts of God

  • weather

  • emergency evacuations

  • power outages

  • or any event outside reasonable control

In the extremely rare event of complete photographic failure, liability is limited to refund of payments received.
No further damages—emotional, consequential, or indirect—will be owed.

10. Force Majeure

Neither party is liable for failure to perform due to circumstances outside their control, including natural disasters, government shutdowns, pandemics, etc.

11. Indemnification

Client agrees to indemnify and hold harmless Lopeman Photography from any claims, damages, injuries, legal fees, or disputes arising from:

  • breach of contract

  • misuse of images

  • actions of guests or participants

  • Client behavior during session

12. Refunds & Satisfaction Policy

All payments are non-refundable.

Photographer will make every reasonable effort to ensure client satisfaction, however:

  • artistic style

  • creative choices

  • lighting conditions

  • editing style

  • posing results

are not guaranteed and are highly subjective.
Client is hiring Photographer for their unique artistic style, and refunds will not be issued for difference in taste or subjective preferences.

13. Governing Law

This agreement is governed by the laws of Nebraska.
All disputes must be filed in Douglas County, Nebraska.

14. Entire Agreement

This document, along with invoices or signed contracts, constitutes the complete agreement between the Client and Lopeman Photography.

No verbal agreements are binding.
All changes must be in writing and signed by both parties.

15. Acknowledgment

By booking services, the Client confirms that they have read, understood, and agree to all Terms and Conditions listed above.
